      Dear Sir, A. Exemption Scheme 1 In case of Exemption Scheme where Invoice raised on 31 March or end of march , No TDS deducted by awarder as no payment made by awarder during FY 2011-12, Whether Contractor is required to deposit EC Fees or no need to pay any fees as( In return it is written amount received by awarder as no payment no fees), Whether to deposit EC Fees on Invoice basis or receipt basis under Exemption Scheme. Suppose Invoice raised on 30 mar for 1 Lakh, but no TDS as no payment received in FY2011-12, whether contractor is required to deposit any EC Fees and claim refund next year or no need to deposit any fees as no amount received . 2 Whether EC Fees to be deposited on Sales plus Service Tax or without Service TAX (100 or 100+Service Tax). 3 In VAT-11 EC Column in 5column whether to show Total Award Value or total Work done till date. 4 In how much time one can get refund as per VAT Rules in case of Excess as TDS 3% but EC 1.5% 5 Confused as to point in VAT-11 which writes amount received by awarder (Para 4 Column 9) whether its only legal language or EC to be deposited on Receipt basis. B. VAT Scheme 1 In case of WORKS Contract tax under VAT scheme we need to calculate Gross Profit to arrive at Sales Value, whether we need to calculate Gp each time of issue Invoicing or there is some other way. 2 Whether Sales Value to arrive after adding Service Tax or Without Service Tax

      One of my client is a registered dealer and opted scheme u/s 3(2) of the Raj. VAT Act. During the assessment procedure after survey at my client business premises, there was not any undeclared goods and unaccounted goods. Not any further documentary evidence would found to department. After physically verification of stock found at the time of survey, the value of closing stock is less then value as per trading account. AO issue a notice under section 25, 61 of Raj. Vat. Act for show cause. He want clarification why a tax amount equal to .50% of total difference of closing stock and a penalty under section 61 equal two time of tax should by charged. I Just want to clarify that what is the provision regarding conversion of vat option from 3(2). Will my client bound to pay tax as per vat provision day after survey.
